Terms of Service

Welcome to CareCall ("we", "us", "our"). By using the CareCall service, you agree to these Terms of Service. If you do not agree, please do not use the service.
1. What CareCall Is
CareCall is an AI-powered companion calling service. Our AI assistant ("Sally") places regular telephone calls to users to provide friendly conversation, routine check-ins, and optional medication reminders.
CareCall is NOT a medical service, emergency service, healthcare provider, or substitute for professional medical advice, diagnosis, or treatment. CareCall does not monitor vital signs, dispense medication, or provide clinical care of any kind.
2. Eligibility
You must be at least 18 years old to create an account. Accounts may be created by a user or by an authorised family member, carer, or legal guardian on behalf of the intended call recipient. The person creating the account confirms they have the authority and consent to do so.
3. Account & Registration
- You must provide accurate information including a valid phone number.
- You are responsible for maintaining the security of your account credentials.
- You may only register one account per phone number.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. The Service
- AI Calls: Sally will call the registered phone number at scheduled times. Call content is generated by artificial intelligence and may occasionally be inaccurate or inappropriate despite our best efforts.
- Conversation Memory: Sally remembers details from past conversations to provide a more personalised experience. This data is stored securely and used solely to improve your calls.
- Medication Reminders: If enabled, reminders are based entirely on information you or your authorised representative enter. We do not verify, prescribe, or dispense medication. Always follow your clinician's instructions.
- Emergency Contact Alerts: If Sally cannot reach the user after multiple attempts, she may call the registered emergency contact. This is a courtesy feature, not a monitored emergency response system.
- Language Support: Sally supports multiple languages. Voice quality and cultural accuracy may vary by language.
5. What CareCall Does NOT Do
CareCall does not:
- Provide medical advice, diagnosis, or treatment
- Replace professional healthcare, nursing, or social care
- Monitor health conditions or vital signs
- Guarantee detection of health emergencies or falls
- Serve as an emergency response or alarm system
- Verify or confirm medication types, dosages, or schedules
If you need urgent medical help, call 999 (UK), 112 (EU & Ireland), or your local emergency number immediately.
6. Subscriptions & Payments
- CareCall offers a free trial of 20 minutes with no card required.
- Paid plans are billed monthly or annually via Stripe. Prices are displayed in GBP (£) at checkout.
- Subscriptions renew automatically at the end of each billing period unless cancelled before renewal.
- Minutes included in your plan refresh at each billing cycle. Unused minutes do not roll over.
- You can cancel your subscription at any time through the app. Access continues until the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact us at hello@carecall.me.
7. Acceptable Use
You agree not to:
- Use CareCall for any illegal, harmful, or abusive purpose
- Attempt to manipulate, exploit, or reverse-engineer the AI system
- Register accounts with false information
- Share account access with unauthorised third parties
- Use the service to harass, threaten, or cause distress to others
8. Availability & Uptime
We aim to provide a reliable service but do not guarantee 100% uptime. Calls may be affected by telephone network issues, server maintenance, or third-party service outages. We are not liable for missed calls due to technical issues beyond our reasonable control.
9. Intellectual Property
All content, branding, software, and AI models used in CareCall are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of the service without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law:
- CareCall is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
- We are not liable for any health outcomes, missed medication, undetected emergencies, or any harm that may result from reliance on the service.
- Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless CareCall, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the service or violation of these terms.
12. Changes to These Terms
We may update these terms from time to time. Significant changes will be communicated via the app or email. Continued use of the service after changes constitutes acceptance of the updated terms.
13. Termination
You may stop using CareCall and delete your account at any time. We may terminate or suspend your access if you violate these terms or if we discontinue the service, with reasonable notice where possible.
14. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
